Scope and Application These Terms and Conditions apply to all contracts, services, and courses offered by the German Compliance Institute (hereinafter referred to as "the Institute," "we," or "us") via our website. By registering for an account or purchasing a course, the user (hereinafter "the User" or "you") agrees to these terms.

Services and Certification

  • Course Offerings: We offer online courses primarily in compliance, as well as IT, teaching, languages, and other categories.

  • Nature of Certificates: Upon successful completion of a course, the User may purchase a certificate of completion issued solely by the German Compliance Institute.

  • No Formal Qualification: The User acknowledges that these certificates represent completion of our internal curriculum and do not constitute formal, state-recognized academic degrees or official vocational qualifications (Berufsabschluss) under German law.

Registration and Contract Formation

  • To purchase a course, the User must create an account and provide accurate, current information.

  • The presentation of courses on our website does not constitute a legally binding offer. It is an invitation to place an order.

  • A binding contract is formed only when the User clicks the final purchase button (e.g., "Buy Now" / "Zahlungspflichtig bestellen") and receives a confirmation email from us granting access to the course materials.

Pricing and Payment Terms

  • All prices listed on the website are in Euros (€) and include the applicable statutory Value Added Tax (VAT), unless stated otherwise.

  • Payment is due immediately upon booking the course. Access to course materials will only be granted once full payment has been received.

Right of Withdrawal (Widerrufsrecht) for Consumers (Note: Under EU/German law, consumers have a 14-day right of withdrawal. However, for digital content, this can be waived if access begins immediately.)

  • Standard Right: If you are a consumer under § 13 BGB (German Civil Code), you have the right to withdraw from this contract within 14 days without giving any reason.

  • Expiry for Digital Content: Your right of withdrawal expires prematurely for digital content (e.g., online video courses, downloadable materials) if we begin to execute the contract after you have expressly agreed that we can start the execution before the withdrawal period expires, and you have acknowledged that by doing so you lose your right of withdrawal.

Intellectual Property and Copyright

  • All course materials, videos, texts, quizzes, and software provided by the Institute are protected by copyright law.

  • Materials are provided for the User's personal, non-commercial use only. Users may not copy, distribute, record, or share their account access or course materials with third parties without our prior written consent.

User Account and Conduct

  • The User is responsible for maintaining the confidentiality of their login credentials.

  • The Institute reserves the right to suspend or terminate a User's account without a refund if the User breaches these terms, engages in fraudulent behavior, or shares access with unauthorized users.

Limitation of Liability

  • The Institute strives to provide accurate and up-to-date information in its courses. However, we do not guarantee that the course content will result in specific career outcomes, job placements, or legal compliance for the User's specific business.

Governing Law and Dispute Resolution

  • These Terms and Conditions and the contractual relationship between the Institute and the User shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

  • If the User is a merchant, a legal entity under public law, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the registered office of the Institute.

  • Online Dispute Resolution: The European Commission provides a platform for online dispute resolution (OS), which can be found at [http://ec.europa.eu/consumers/odr/]. We are not obligated and generally unwilling to participate in dispute resolution proceedings before a consumer arbitration board.

Severability Clause If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall not be affected.
